New York legalized same-sex marriage on June 24, 2011, but many legal pitfalls still remain for the unwary because of the conflict between New York’s law and the federal Defense of Marriage Act which defines marriage as between a man and a woman. This CLE will discuss both the state and federal law and how the practitioner can counsel same-sex couples on their rights and obligations under state and federal law in the areas of estates planning and matrimonial law.
