The Sky & The City: Development Rights in NYC

Description:
This session examines the fundamentals of air rights in the New York City development process and its implications for real estate transactions. The session will address the legal history of air rights and describe the ways in which the city’s zoning code and land use policies govern their use, sale, and transfer. Through case studies of major redevelopment projects in New York City, the session will also show how air rights are playing a critical role in some of the city’s most critical planning issues including the redevelopment of Penn Station, the adoption of mandatory inclusionary zoning, and the revitalization of outer borough neighborhoods. Finally, the session will provide practical guidance on the utilization of air rights including the fundamentals of zoning lot mergers, title issues, unique zoning provisions, landmark considerations, and the rules affecting special districts.
