Course Description:
Medicare Liens, ERISA liens and Health Insurance Company subrogation claims have become the bane of every personal injury attorney’s existence. There are few personal injury cases where some entity or another is not aggressively trying to lay claim to the proceed’s of your client’s verdict or settlement. In order to effectively represent your client (and protect yourself) you must be able to ascertain the validity of these claimed liens. Only by being familiar with the statutory framework and recent case law on the subject can you navigate this dangerous minefield and protect your clients’ interests. This informative and timely program will focus on: the newest rulings in Medicare reimbursement; recent attacks on New York’s antisubrogation statute; identifying ERISA plans; and your obligations to the lien/claim holder.
