In the wake of the New York Court of Appeals’ opinion rendered in Brook S.B., the passage of New York’s Marriage Equality Act and the Supreme Court’s decision in Obergefell v. Hodges, numerous issues have arisen surrounding the presumption of who may qualify as a parent under the law.

Our panel’s discussion of these issues will include: – What the precedent of Brook S.B. means for unmarried couples
– Whether the presumption of legitimacy is available to same sex couples
– When is second parent adoption necessary
– Under the current law, will the New York Courts recognize a child having more than two parents
– A discussion of the Parent Child Securities Act.

Mark Sullivan, author of “The Military Divorce Handbook” will speak on the newly enacted SERVICES FORMER SPOUSES’ PROTECTION ACT (USFSPA), which radically changes the Majauskas Rule in New York .  The new federal law, also called “The frozen Benefit Rule” requires that the pension to be divided in such cases is the member’s retired pay as if he or she had retired on the date of the court order dividing the pension as property.
